Not at all. It's down to the laws in the host country. You step over my doormat and you're on my rewls. This is why hosting providers establish ToC and AuP - to stop them being liable. This is why you never find them contradicting the law of the host country. You really need to do better research.

No, that's the only way around it works. Because where the infrastructure physically is dictactes the jurisdiction. And again, why providers insulate themselves against this by passing the buck to the end customer and then having to be seen enforcing it's AuP/ToC to demonstrate adherence to local law.
