Assuming anon isn't lying to us (lmao) the actual court case (if it went to court) would be for trademark infringement - when you see "Warhammer™" that means that GW "marks" all products that they "trade" with the trademark "Warhammer™" which, legally, they are the only company that's allowed to do so. This serves two purposes - you, as a consumer, know your models are made to the quality that you expect from GW, and GW in turn controls the quality you associate with the word "warhammer" because they control the production.

If somebody not-GW trades a not-GW product marked in such a fashion that it might confuse a consumer into thinking it's a GW product, that infringes on GW's right to be the only people using GW's trademarks.

yes I know. I know. But trademark law is retarded and if companies don't get legal when it looks like something COULD infringe on their trademarks, they might lose them.

(Catalyst might have copyright case if they were copies of battlemech designs)
